well i would think in court if they had nothing to do with it in some way or another, that they should be able to prove that easily and show that only the employees that committed it are responisble... But actually having that in the contract almost implies that they can ignore it happening or whatever instead of attempting (at the very least) to offer a safe and fair work environment. And that they do not need to give any sort of assistance to any victim of such abuse.
in theory, if they arent resposible for it happening or whatnot, then they shouldnt have to worry about a lawsuit, because technically if they arent they should be found not guilty anyway.. its almost like a 'just incase we are responsible... too bad for you' thing.. And having that in there means that they can neglect whats going on, which to me, whether or not they are responsible, isnt very ethical
